Meeting of the Board of Alderman of the City of Clarkson Valley, July 9, 2024.

Mayor McNamara led everyone in the Pledge of Allegiance.

Mayor McNamara stated that there will be a Public Hearing tonight but not a closed meeting.

AGENDA APPROVAL
Mayor McNamara asked for a motion and a second to approve the agenda as posted. Alderman Midyett made the motion, seconded by Alderman Schweig. The motion passed.

ACCEPTANCE OF MINUTES
Mayor McNamara asked for a motion to waive the reading of the Minutes. Alderman MacDonald made the motion to waive the reading of the minutes, seconded by Alderman Schweig. Mayor McNamara called for a voice vote which resulted in all ayes. The motion passed.

REMARKS, PETITIONS, COMPLAINTS
Mayor McNamara stated that there will be a Public Hearing tonight at 7:00pm to discuss the Forest Hills
Country Club request for a Special Use Permit to install a chain link fence exceeding the height of six (6) feet around their pickleball courts on the property known as 36 Forest Club Drive.

REPORTS

Chesterfield Police Report:
Lt. Connelly presented the June 2024 Police Activity Report.

Mayoral Update:
1. The amount of court revenue for June was $3,654.14.

2. Mayor McNamara attended the Kehrswood Annual Picnic on June 8, 2024.

3. Marquette High School football Mayor’s Bowl is coming up in August.

Status Report from Aldermen:
Alderman MacDonald stated that he will present the cyber security awareness options he collected, one of which is offered through Amazon free of charge. He will present the information to the Board at next month’s meeting.

Alderman Schiller stated she attended the Planning and Zoning Meeting and the commission recommended that the Board approve the Forest Hills petition at tonight’s meeting.

City Attorney Report:
Patrick Butler, the City Attorney said the City was in good standing and had nothing to report.

UNFINISHED BUSINESS

EyeCare Partners Lease Agreement and Update on Office Modification:
Mayor McNamara stated EyeCare Partners presented a 5-year lease with two 2- year extension options, (copy of Lease included in Alderman binder).

Discuss – Approve 2024-2025 Budget:
Mayor McNamara asked for a motion to discuss and approve the 2024-2025 Budget. It was agreed that Office Modifications and Rent will be indicated by two individual line items on the 2024-2025 Budget. Mayor McNamara asked for a motion and a second to discuss and vote on the 2024-2025 Budget, as presented. Alderman Midyett made the motion to discuss, Alderman Schiller seconded, discussion ensued. Office modifications, Salaries and Mosquito Spray were discussed. The Regular Board of Alderman meeting was suspended for the Public Hearing at 7:00 pm. Michele, the City Administrator, read the Notice of Public Hearing.

Notice is hereby given:
That the Board of Alderman of the City of Clarkson Valley, Missouri, will at 7:30 p.m. on Tuesday, July 9, 2024 at the Clarkson Executive Center, 15933 Clayton Road, hold a public hearing to discuss a request of a special use permit to allow the use of a chain link fence exceeding the height of 6 feet at the property known as Forest Hills Country Club, 36 Forest Club Drive, Clarkson Valley, Missouri 63005.

Emma Gore, Forest Hills Country Club General Manager introduced herself and described the reason for the request. Alderman Schiller requested the Board vote on this issue and not wait until New Business, all agreed.

BILL NO. 0546 – AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, IN TITLE IV: ZONING REGULATIONS, ARTICLE IV, SECTION 405.120 SPECIAL USE REGULATIONS; PARAGRAPH B, BY AMENDING SUB-PARAGRAPH 16.
Mayor McNamara called for a motion to discuss and vote on Bill No. 0546. Alderman Schiller made a motion to discuss and vote on Bill No. 0546, seconded by Alderman Schweig. The City Administrator read Bill No. 0546 for the first time. There was no discussion. The City Administrator read Bill No. 0546 a second time then called roll with the following results: Ayes: Schiller, Midyett, Schweig, Bogosian, and MacDonald. Mayor McNamara declared Bill No. 0546 passed and will become Ordinance No. 24-04.

BILL NO. 0547- AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO FOREST HILLS COUNTRY CLUB AUTHORIZING THE LOCATION OF A VINYL COATED CHAIN LINK FENCE THAT EXCEEDS THE HEIGHT OF SIX (6) FEET AT THE PICKLEBALL COURTS ON PROPERTY KNOWN AS 36 FOREST CLUB DRIVE IN THE CITY OF CLARKSON VALLEY, MISSOURI.
Mayor McNamara called for a motion to discuss and vote on Bill No. 0547. Alderman Midyett made a motion to discuss and vote on Bill No. 0547, seconded by Alderman Schweig. The City Administrator read Bill No. 0547 for the first time. There was no discussion. The City Administrator read Bill No. 0547 a second time then called roll with the following results: Ayes: Schiller, Midyett, Schweig, Bogosian, and MacDonald. Mayor McNamara declared Bill No. 0547 passed and will become Ordinance No. 24-05.

Resume Discussion and Approval of 2024-2025 Budget:
Mayor McNamara declared the Regular Board of Alderman Meeting back in session. Alderman Schiller asked how long the current Police and Sanitation contracts were valid. The City Administrator indicated there are three years until the current Police contract is due for renegotiation and two years for the Sanitation contract.

Mrs. Bogosian, a Clarkson Valley resident, requested information to be reviewed at the monthly meetings be available to the public prior to the meeting. Mrs. Bogosian also asked to have any changes to the budget be publicly available.

Alderman Schiller made a motion to approve the 2024-2025 Budget, which was seconded by Alderman Midyett. A voice vote was taken with an affirmative result. The motion passed.

Revisit and Approve Appointments/Reappointments of Board of Adjustment and Planning & Zoning Members:
Alderman Schiller requested that potential members resume the practice of submitting their resumes to the Board for review. The omission of the appointment of Valorie Denton as an alternate to the Planning and Zoning Commission at the May Regular Board of Alderman meeting was discussed. Terms of appointed members was explained. The City Administrator explained the appointed members of an unexpired term take on the remainder of the life of that given term. Alderman Bogosian made the motion to accept the appointments and reappointments, seconded by Alderman Midyett. A voice vote was taken resulting in all ayes. The motion passed.

Discuss Building Permit Fee Structure Procedure:
Alderman Bogosian and Alderman MacDonald presented the Proposed Building Permit Cost Structure. Alderman Bogosian is asking for the Board approval on the presented fee structure. Discussion ensued. The Clarkson Valley Building Commissioner, Brad Holmes stated that the cost of a permit fee is traditionally based on the value of the project and is a method recommended by the 2009 International Residential Code. Alderman Bogosian asked for a motion to approve the presented permit fee structure and have Patrick Butler; the City Attorney draw up the ordinance. Mayor McNamara asked to go record that she is not in favor of this fee structure due to its complexity, and it does not cover the City’s costs for nuisance follow up. The Mayor also asked that Alderman Bogosian and Alderman MacDonald include nuisance costs into the new permit fee structure or present an alternative to the Board. Alderman Schiller made a motion to approve the new permit fee structure, seconded by Alderman Schweig. A voice vote was taken with an affirmative result. The motion passed. The legislation necessary for final approval will be presented at the August 6, 2024 meeting.

NEW BUSINESS

Discuss Brick Columns off Driveways to allow them under certain conditions (height, location, use, number, size, materials, neighbor approvals):
Brad Holmes, the Building Commissioner suggested to the Board that it may be within the City’s best interest to regulate pillars by making it a code amendment, the City Attorney Patrick Butler, concurs. Discussion ensued. Alderman MacDonald made the motion that the board support the criteria to work with the City Attorney to allow decorative columns in the front yard, seconded by Alderman Midyett. A voice vote was taken with the following result: Ayes from Bogosian, MacDonald, Midyett, and Schweig but opposed by Alderman Schiller. The motion passed.

RESOLUTION 24-06: RESOLUTION OF THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY APPROVING THE PAYMENT OF AMERICAN RESCUE PLAN ACT (“ARPA”) FUNDS TO THE
HOMEOWNERS ASSOCIATION OF KINGSPOINTE (“KINGSPOINTE”)
Mayor McNamara called for a motion to discuss and vote on Resolution 24-06. Alderman Scweig made a motion to approve Resolution 24-06, seconded by Alderman Midyett. The City Administrator read Resolution 24-06. A voice vote was taken with an affirmative result. Mayor McNamara declared Resolution 24-06 passed.

AUDIT

Mayor McNamara asked for a motion and a second to discuss and accept the July 2024 Audit as posted. Alderman Schiller made the motion to accept the audit, seconded by Alderman Schweig. A voice vote was taken with an affirmative result. The motion passed.

Discussion ensued regarding the City adopting “Administrative Action” into the code. This would enable the City to remediate the nuisance and bill for repeated non-responsive nuisance issues. Unpaid bills can then be filed as a lien with St. Louis County which will be placed on the residents December tax bill. The Board agreed to revisit this issue at next month’s Regular Board of Alderman meeting.

ADJOURN

Alderman Bogosian made a motion to adjourn, seconded by Alderman Midyett. A voice vote was taken with an affirmative result. Mayor McNamara declared the meeting adjourned at 8:25 pm.
