Meeting of the Board of Aldermen of the City of Clarkson Valley at City Hall (Fru-Con Center), December 4, 2012.

The meeting was called to order at 7:30 p.m. A roll call was taken with the following results:

Alderperson Schultz made a motion to accept the Minutes.  Alderperson Midyett seconded the motion.  A voice vote was taken to accept the Minutes with an affirmative result and the motion was declared passed.  

REMARKS, PETITIONS AND COMPLAINTS 

Mr. Tom Dillon, a resident of Kehrs Mill Trails Subdivision asked a question regarding annexation. 

REPORTS 

St. Louis County Police Report:  Officer John Wehner handed out the January 2013 Police Report.   

Mayor’s Report 

Court Report:  The total amount collected for traffic fines and court costs for the month of January 2013 was $11,075.71.  

Insurance:  Mayor Douglass spoke on the subject of health, dental and liability insurance and how the quotes were inline with the budgeted amounts this year.   

Deer Harvested:  Mayor Douglass reported the harvest tally for the year, which was lower than in years past.  There were 22 does and 2 bucks taken.   

Alderpersons' Reports 

Judge Lusser Retiring:  Alderperson Meyer mentioned there would be a significant retirement this year when the Judge leaves in March and is hoping the City can celebrate by Proclamation for the years of service Judge Lusser gave his municipality. 

Neighborhood Patrol Officer:  Alderperson Schultz reported he met with the Neighborhood Patrol Officer, John Wehner this past month to gather ideas of how the subdivisions can work in unison with the police to maintain a safe community. 

Open-Heart Surgery:  Mayor Douglass reported that Alderperson Schultz would be having open-heart surgery February 14 at Missouri Baptist Hospital in order to repair a heart valve.  Our thoughts and prayers will be with Mr. Schultz. 

City Attorney's Report 

There was no report.

There was no unfinished business.   

NEW BUSINESS 

BILL NO. 0440 - AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CLARKSON VALLEY, MISSOURI, IN TITLE I: GOVERNMENT CODE, CHAPTER 125: MUNICIPAL COURT, BY ADDING A NEW SECTION 125.031: PROVISIONAL JUDGE - SELECTION.

A motion was made by Alderperson Meyer to discuss and pass Bill No. 0440.  Alderperson King seconded the motion.  Mayor Scott Douglass read Bill No. 0440 for the first time.  There was no discussion.  Mayor Douglass read Bill No. 0440 the second time.  A roll call vote was taken, with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz, and Sittser.  There were no Nays.  Whereby, Mayor Douglass declared Bill No. 0440 as having passed and is now Ordinance No. 13-01. 

Appointing Provisional Judge:  Mayor Scott Douglass stated he would like to appoint April Porter to serve as the Provisional Judge.  Alderperson Meyer made the motion to appoint Ms. Porter to Provisional Judge, seconded by Alderperson Schultz.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.  

Appointing Prosecuting Attorney:  Alderperson Meyer spoke highly of the Attorney Chris Graville who is currently serving as Prosecuting Attorney for six other cities and villages.  He then made a motion that we appoint Chris Graville to fill the vacancy left by April Porter's appointment as Provisional Judge.  Alderperson Schultz seconded the motion.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

 

BILL NO. 0441 - AN ORDINANCE OF THE CITY OF CLARKSON VALLEY, MISSOURI, REAFFIRMING THE GROSS RECEIPTS TAX TO BE IMPOSED UPON ELECTRIC CORPORATIONS CONDUCTING BUSINESS WITHIN THE CITY AND MATTERS RELATED THERETO.

A motion was made by Alderperson King to discuss and pass Bill No. 0441.  Alderperson Midyett seconded the motion.  Mayor Scott Douglass read Bill No. 0441 for the first time and explained the Public Service Commission approved an increase in excess of 10% with Ameren.  When that occurs, cities can either roll back the percentage they collect on gross receipts or pass an ordinance to continue receiving the same amount, which in our case is 2%.  Mayor Douglass read Bill No. 0441 the second time.  A roll call vote was taken, with the following results.  Ayes: King, Meyer, Midyett, Schiller, Schultz, and Sittser.  There were no Nays.  Whereby, Mayor Douglass declared Bill No. 0441 as having passed and is now Ordinance No. 13-02. 

RESOLUTION NO. 13-01 - RESOLUTION OF THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY ENDORSING THE APRIL 2013 SALES TAX PROPOSAL FOR LOCAL PARKS, GREAT RIVERS GREENWAY AND ARCH GROUNDS IMPROVEMENTS ON BEHALF OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI.

A motion was made by Alderperson Midyett to discuss and pass Resolution No. 13-01.  Alderperson Sittser seconded the motion.  Mayor Scott Douglass read Resolution No. 13-01 the first time.  Alderperson King asked for clarification on whether the Board was being asked to recommend or to endorse.  Mayor Douglass said it was an endorsement.  A roll call vote was taken, with the following results.  Ayes:  Midyett and Sittser.  Nays:  King, Meyer, Schiller and Schultz.  Whereby, Mayor Douglass declared Resolution No. 13-01 as having failed. 

Audit:  Alderperson Sittser made a motion to approve for payment invoices in the amount of $80,696.27, seconded by Alderperson Meyer.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.

Alderperson Schultz made a motion to adjourn, seconded by Alderperson Meyer.  A voice vote was taken with a unanimous affirmative result and the motion was declared passed.  The Meeting of the Board of Aldermen adjourned at 8:15 p.m.
