AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO MERCY MODIFYING THE PREVIOUS SPECIAL USE PERMIT (ORDINANCE 10-05) ELIMINATING THE MOUNTED SIGN ON THE SOUTH ELEVATION AND AUTHORIZING LARGER LETTERING ON THE EASTERN ELEVATION AT 15945 CLAYTON ROAD IN THE CITY OF CLARKSON VALLEY, MISSOURI.

            WHEREAS, an application has been received from MERCY for a Special Use Permit for the permanent location of signage on the eastern elevation at 15945 Clayton Road in the City of Clarkson Valley, Missouri; and

            WHEREAS, Mercy chose not to install a sign on the south elevation; and

            WHEREAS, the said application has been referred to the Planning and Zoning Commission which recommended the granting of said petition; and

            WHEREAS, due notice of a public hearing before the Board of Aldermen for such petition was published according to law and Ordinance; and

            WHEREAS, a public hearing was held on April 30, 2012 at which time the said application was considered; and

            WHEREAS, the location of a permanent sign under certain conditions constitutes a demonstrable need and would generally be in keeping with the standards set forth in Section 405.120 of the Clarkson Valley Land Use Ordinance;

            NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:

            SECTION 1:  A Special Use Permit, subject to the conditions hereinafter specifically set forth, is hereby granted to MERCY to locate permanent signage on the eastern elevation at 15945 Clayton Road in Clarkson Valley, Missouri, as is provided for in Section 405.120 of the Clarkson Valley Land Use Ordinance. 

            SECTION 2:  The Special Use permit hereby issued and referred to in Section One is issued to the named permittee only and shall not be assigned nor transferred.

            SECTION 3:  The Special Use Permit hereby issued and referred to in Section One shall be valid only under the following conditions:

1. The signage which is designated Sign 3 will be located as set forth in the attachment to the application and marked Exhibit "A" at 15945 Clayton Road in the City of Clarkson Valley, Missouri.

2. The sign shall not exceed 11' 2-3/4" in length nor shall it exceed 4' 5-1/2" in height and shall be meticulously maintained with respect to weathering.  The sign shall be constructed of LIF-30-W Illuminated White Channel Letters - face lit for a total of 32 square feet as set forth in the attachment to the application and marked Exhibit "B".

3. The sign shall be installed substantially as set forth in the attachment to the application and marked Exhibit "C".

4. The applicant shall notify, in writing, the City Clerk within 30 days from the passage of this Ordinance that the Special Use Permit as provided for herein is accepted, together will all conditions and that they will be observed.

SECTION 4:  This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
