A fee will be assessed at the rate of twenty-eight dollars ($28.00) per year per residential household to provide funds to pay the cost for certain repairs of defective lateral sewer service lines serving such households (as defined by Section 405.080:B.1.Single Family Dwellings).
Assuming fees collected exceed expenditures, the Board of Alderpersons may waive all or any portion of the fee for any period of time it chooses with the provision it may be resumed without an affirming vote of the people in order to meet increasing demand.
A sewer lateral is defined as the portion of pipe that carries household wastes
to the Metropolitan Sewer District sewer main and extends from the building
foundation wall or exterior wall to the sewer main in the street or sewer
easement. Neither sewer laterals running from the septic nor any damaged or
blocked pipes located within 6' of the exterior walls of the household are
covered under this policy. A lateral sewer line may be located in the front,
side or rear yard.
The City will authorize reimbursement up to five thousand dollars ($5,000.00) of the repair costs related to a defective lateral if, after investigation (see procedure) the lateral is found to be damaged due to causes beyond the control of the property owner resulting in pipe cracks or leaking joints, including pipe infiltration by tree roots or soil resulting in a blockage of the pipe rendering the lateral not functional. Simple blockages that can be corrected by sewer cleaning, i.e. cabling, will not be covered under this program. Only repairs necessary to prevent the leaking or seepage of sewage or irreparable blockages rendering the lateral non-functional shall be authorized for reimbursement under this policy.
The City does not provide any repair services and does not provide any expert advice regarding the repair of lateral sewer lines. The City will only issue reimbursement for the cost of necessary repairs limited to the excavation and repair of the lateral pipe, and backfilling in a workmanlike manner for repairs necessary under Paragraph 5 of this Policy. It is the responsibility of the homeowner to restore landscaping and ground cover in whatever manner they choose. The City is not responsible for restoration of the yard to a grass or landscaped surface and will not issue any funds for reimbursement for costs related to such purposes.
The City of Clarkson Valley and the lateral fund will not be responsible for any damage to owner's or neighbor's personal or real property, including personal injury, caused by sewer backups, lateral failures, or the errors, omissions, or actions, whether intentional or unintentional, of the contractor, including his agents, successors, and/or assigns, selected by the homeowner to perform the necessary repairs.
The money generated from this fee can be used to replace driveways and streets as necessary to accomplish the repair, subject to the limitations contained in paragraphs 6 and 7 of this Repair Policy.
The maximum reimbursable amount for a homeowner under this policy is either the lowest responsible bid for the repairs or the sum of five thousand dollars ($5,000.00), whichever is the smallest amount.
