AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO MR. AND MRS. BRADLEY MILLER TO LOCATE A BUILDING-MOUNTED SOLAR ENERGY SYSTEM AT PROPERTY KNOWN AS 16598 KEHRSGROVE DR. IN THE CITY OF CLARKSON VALLEY, MISSOURI.

            WHEREAS, an application has been received from MR. AND MRS. BRADLEY MILLER for a Special Use Permit for the permanent location of a solar energy system at property known as 16598 Kehrsgrove Dr. in the City of Clarkson Valley, Missouri; and

            WHEREAS, the said application has been referred to the Planning and Zoning Commission which recommended the granting of said petition; and

            WHEREAS, due notice of a public hearing before the Board of Aldermen for such petition was published according to law and Ordinance; and

            WHEREAS, a public hearing was held on November 25, 2013 at which time the said application, including any proposed amendments and/or proposed revisions to the application, was considered; and

            WHEREAS, the location of permanent solar energy systems under certain conditions constitutes a demonstrable need and would generally be in keeping with the standards set forth in Section 405.120 of the Clarkson Valley Land Use Ordinance;

            NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CLARKSON VALLEY, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:

            SECTION 1:  A Special Use Permit, subject to the conditions hereinafter specifically set forth, is hereby granted to MR. AND MRS. BRADLEY MILLER to install a building mounted, grid tied solar PV system consisting of twenty-eight (28) "Sunmodule Mono Black" panels installed on the southeast portion of the roof at the rear of the residence at the property known as 16598 Kehrsgrove Dr. in the Dunhill Subdivision in the City of Clarkson Valley, Missouri, as provided in Section 405.120 of the Clarkson Valley Land Use Ordinance.

            SECTION 2:  The Special Use permit hereby issued and referred to in Section One is issued to the named permittee only and shall not be assigned nor transferred.

            SECTION 3:  The Special Use Permit hereby issued and referred to in Section One shall be valid only under the following conditions:

1. The panels shall be installed as set forth in the attachment to the application marked Exhibit "A".

2. The panels shall be constructed substantially as set forth in the attachment to the applications marked Exhibit "B".

3. All supports and flashing shall be painted to match roof color.  All panels shall be meticulously maintained with respect to the elements, weathering and vandalism and shall be removed when system becomes non-functional or when owner ceases to use systems.

4. The applicant shall notify, in writing, the City Clerk within 30 days from the passage of this Ordinance that the Special Use Permit as provided for herein is accepted, together will all conditions and that they will be observed.

SECTION 4:  This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
